Terms of Use – Thinkific

The Minded Institute: Minded CPD maintains any courses offered on Thinkific (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and The Minded Institute – Minded CPD. If you do not agree to these terms, do not use this Site. Failure to abide by any of the terms or conditions set forth in this Agreement shall be grounds for The Minded Institute – Minded CPD to deny access to the Site.

1. Use of Site

The Minded institute provides various materials, information, videos, tests, questions, and other information on this and related sites and in courses offered through this site (the “Materials”). The Minded Institute authorizes each User to view the Materials. Materials marked as ‘downloads’ may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.

2. Trademark and Copyright

The Minded Institute owns and retains all proprietary rights for the course content on the Site. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws. You may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

3. Limitation of Liability

In no event will The Minded Institute be liable for any damages whatsoever (including, without limitation, those resulting from yoga practices) arising out of the use, inability to use, or the results of the use of this Site (including the Users personal teaching practices learned via this platform, to clients and any complications or injuries that arise to clients taught or guided by participants on Minded Training Courses), any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

Participants are responsible for their own health and well-being for the duration of the training. It is the participants responsibility to follow the directions given to them by the teacher and if for any reason the participant feels the directions do not meet their needs, they must immediately cease continuing the practice and contact The Minded Institute with their concerns.

4. Disclosure By Law

You acknowledge and agree that Minded may disclose information you provide (including, without limitation, PII) if required to do so by law, at the request of a third party (including, without limitation, law enforcement agencies), or if Minded, in its sole discretion, believes that disclosure is reasonable to (i) comply with the law, requests or orders from law enforcement; (ii) protect or defend Minded’s, or a third party’s rights or property; or (iii) protect someone’s health or safety, such as when harm, violence or abuse against any person is threatened.

5. Governing Law

The Terms of Use are governed by the laws of the United Kingdom. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. Alpha Score Seminars Inc. may assign its rights and duties under the Terms of Use without notice to any party at any time.

6. Termination

You acknowledge and agree that Minded may, with or without cause, immediately terminate your access to the Site without prior notice. Minded is not required, and may be prohibited, from disclosing a reason for the termination of your access. Reasons for termination shall include, without limitation, (i) breaches or violations of this Agreement Minded’s policies as may be in effect from time to time, (ii) requests by any governmental agency, and (iii) technical problems. Minded may terminate your use by sending notice to you at the email address you provide in your registration with the Site, or such other email address as you may later provide to Minded. All decisions regarding the termination of your access shall be made in the sole discretion of Minded. Even after your access is terminated, this Agreement will remain in effect. All terms that by their nature may survive termination of this Agreement shall be deemed to survive such termination.

7. Refunds

The Minded institute does not offer any refunds and all purchases are final. If the User wishes to learn more around the course content, prior to purchase, they may contact The Minded Institute directly and review the lesson previews contained in the Site.

7. Effective Date and Updates

The Terms are effective as of 28^th January 2021 and are subject to change without notice by The Minded Institute at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
